This website, www.pawsandpalmstherapy.co.uk will be referred to as the “Site”.  All visitors to the Site will be referred to as “User” “You” or “Your”. As a user, you will be bound by these Terms of Use which may also be referred to from time to time as Terms and Conditions. The terms “We” “Us” and “Our” refer to Paws & Palms Therapy Accessing and using the Site constitutes acceptance of the Terms of Use.

By using this Site you agree to the Terms and Conditions without modification. We reserve the right to amend the Terms of Use of this Site and on doing so we will update these Terms and Conditions.

This Site is intended for use by persons who are a minimum of 18 years old. 

You must not copy, share or disseminate the information on this site which is subject to copyright for which all rights are reserved.

This Site is directed to people residing in the United Kingdom. We do not represent that the content will be available or appropriate in other locations. This Site is written in English, and we do not take responsibility for any translations which are applied to this Site.

In using this Site you may encounter comments and/or content supplied by other users. The information contained within user comments is not verified or approved by us. The views expressed by other users on the Site do not represent our views or values.

TERMS

The content on this Site, and the associated social media channels (via Facebook (Paws and Palms Therapy) and/ or Instagram (pawsandpalmstherapy) and email marketing, will include information on dog training and behaviour. All content is intended for informational purposes only. None of the content in emails, blog posts or social media posts should be construed as specific dog training or dog behaviour advice. 

In addition to these Terms of Use please be aware of our Privacy Policy which include key terms which are set out separately on our Site.

SITE OPERATION

This Site is available free of charge.

We do not guarantee the availability of any Site or content. We reserve all rights to withdraw, suspend or restrict the content at any time for any reasons. Where possible, we will give you reasonable notice if the Site is to be suspended. 

We do not guarantee that this Site will be secure or free from bugs or viruses. 

You are responsible for configuring your information technology, computer programmes and platform to access our Site. You should use your own virus protection software.

LOSS OR DAMAGE

Not with standing any of these terms, we do not intend to exclude or limit our liability to you where it would be unlawful to do so. We do not exclude or limit liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

We have no liability to You for any loss of profit, loss of business, business interruption or loss of business opportunity. To the maximum extent permissible at law, our aggregate liability to you in connection with these terms howsoever arising in contract, negligence or otherwise, is limited to £250.

REFUND POLICY

Please see the full terms applicable to your service that are available at the point of booking/payment. 

 Should you decide to purchase any dog training, dog behaviour or any course or workshop product from this Site and/or through the booking system, then you will enter into a contract of sale with us at the point of sale. If you change your mind about purchasing, you are entitled to a refund for the 14 days following the purchase. Should your programme start, or any work is commenced by Us within that 14-day period and you decide to cancel then you will be refunded, but the amount of any sessions or value received will be deducted from your refund. Deductions will be calculated on a pro-rata basis.

Should you have any questions about your purchase, we will be happy to assist.

The information on this website is intended for entertainment and information purposes only and does not constitute dog training or dog behaviour advice. The information on this Site is provided without any representations or warranties, express or implied.

                            Terms & Conditions

Terms and Conditions of Services Effective 01.05.2022. Paws and Palms Therapy, hereafter referred to as “we”, “our” or “us”, is a one-person entity that provides dog related services of 1-2-1 dog and puppy training, group classes and behavioural treatment sessions, collectively known as the “service(s)”, “session(s)” or “booking(s)”. The “Client(s)”, “Owner(s)”, “Handler(s)” refers to the person filling out the Enrolment Form and anyone affiliated with the dog that attends a training session, be that in person or via video call. 

In the interests of safety to Paws and Palms Therapy, speakers, volunteers, Clients, Handlers, attendees and spectators please read and agree to the following conditions. 

This declaration sets out the terms on which Paws and Palms Therapy accepts you on any sessions. When you agree to this declaration, you will be bound by all of Paws and Palms Therapy’s Terms and Conditions. 

Paws and Palms Therapy reviews and changes these conditions from time to time in order to assist the proper delivery of services and education.  Paws and Palms Therapy reserves the right to introduce changes at any time when it is in the interest of Clients, Handlers, Paws and Palms Therapy speakers and dogs.

CLIENT DISCLOSURE AND HONESTY 

By engaging the services of Paws & Palms Therapy, the Client agrees that all information provided regarding their animal’s behaviour, history, and any relevant circumstances is truthful, accurate, and complete to the best of their knowledge. The Client acknowledges that withholding, misrepresenting, or failing to disclose pertinent details, such as previous aggression, medical conditions, or behavioural concerns, may pose a significant risk to the safety of the practitioner, the Client, the animal, and others. Under the Animal Welfare Act 2006, all animal owners and keepers have a legal duty of care to ensure the welfare of their animals and to prevent harm to others. In the case of dogs, the Dangerous Dogs Act 1991 and related legislation impose additional responsibilities to prevent a dog from being dangerously out of control. Failure to provide full and honest disclosure may result in the immediate termination of services without refund, and Paws & Palms Therapy shall not be held liable for any consequences arising from such omissions. The Client accepts full responsibility for any legal repercussions that may arise from undisclosed behavioural issues or other relevant factors. You understand and accept that your dog (and their behaviour) remains entirely your responsibility at all times, whether or not in the presence of the trainer/ behaviourist.

BOOKINGS

1. All fees must be paid at the time of booking. A booking cannot be made or confirmed without full payment.

2. Payment confirmation, booking confirmation, session reminders and correspondence from Paws and Palms Therapy will be sent via email or text to the address or number you provide. Please ensure these details are correct at the time of booking.

3. All training sessions must be booked in straight away once you have paid. Paws and Palms Therapy can be booked up approximately 6 - 8 weeks in advance so sessions must be booked in to avoid disappointment and long gaps between training sessions.

4. All bookings of multiple sessions in a training programme must be completed within a set time period to ensure continuity and momentum in training.

-      Puppy Programmes to be completed weekly over a maximum of 10 weeks

5. Behaviour Programmes, sessions must be completed within 6 months unless otherwise agreed. 

 

RESCHEDULING OF APPOINTMENTS

6. Paws and Palms Therapy is a small appointments based business and cannot function with prolonged rescheduling of sessions from Clients. However, Paws and Palms Therapy appreciates that life events and circumstances outside of the Clients control can happen and aims to be flexible within reason, within the limits of our business hours and the terms and conditions stated here.

7. When booking with Paws and Palms Therapy, please ensure you have sufficient time to commit to the training sessions and training between sessions. If you are unable to do this and anticipate you will be regularly rescheduling sessions, please wait until you have more available time to commit before booking.

8. Paws and Palms Therapy permits the following number of rescheduled sessions per booking. Upon reaching the limits stated below, the Client will lose any further sessions they require to be rescheduled and no refund shall be given.

            - Single sessions can be rescheduled only once

            - The Puppy programme permits a maximum of 2 rescheduled sessions

            - Behavioural programmes permit a maximum of 1 rescheduled session.

9.    Any further requests for sessions to be rescheduled beyond the limits stated above will only be granted at the discretion of Paws and Palms Therapy.

10.  If the Client becomes unavailable for the original date and time of their booking they must give Paws and Palms Therapy at least 48 hours notice, and the booking will be rescheduled for a mutually convenient time. If less than 48 hours notice is given the Client will lose the session.

 

PAYMENTS, CANCELLATIONS, TERMINATION OF CONTRACT AND REFUNDS

11.  Cancellation requests of the entire booking made up to 72 hours prior to the first session (including any online consultations or sessions) will incur the full fee.

12.  Cancellation requests of the entire booking made between 72 hours to 14 days prior to the first session will incur a 50% cancellation fee.

13.  Cancellation requests of the entire booking made 14 days or more prior to the first session will receive a full refund. 

14.  A 14 day statutory cancellation period is given after booking a service. If your booking is made within 14 days of the start of the service then you agree to waive your right to rely upon the 14 day statutory cooling off and cancellation period. 

15.  If the Client makes the decision to re-home their dog once training has commenced, a refund will not be given for any sessions taken or the remainder of the sessions not used.

16.  If the Client moves outside of Paws and Palms Therapy service area once training has commenced, a refund will not be given for any sessions taken or the remainder of the sessions not used. The option to complete the sessions via zoom will be given.

17.  If the Client decides to terminate the booking/service once training has started, a refund will not be given for any sessions taken or the remainder of the sessions not used.

18.  Paws and Palms Therapy reserves the right to terminate the contract (at any time and with immediate effect and no refund) if any dog/s under the contract does not respond well to the training plan where continuing of said contract is deemed by Paws and Palms Therapy to constitute a risk.

19.   Paws and Palms Therapy reserves the right to terminate the contract (at any time and with immediate effect and no refund) if the Client or anyone with their dog is abusive towards any Paws and Palms Therapy staff or volunteers.

20.  If a Client is non compliant or withholding information with regards to the behaviour of their dog, including but not limited to aggression, which could compromise the safety of Paws and Palms Therapy staff or volunteers then the contract will be terminated immediately and no refund given.

21.  Any refunds granted will be paid to the Client on the card the original service was booked with. Refunds will take between two to seven working days to appear in the Clients account.

22.  Paws and Palms Therapy cannot guarantee payout from insurance companies for behavioural treatment as the decision ultimately lies with the insurer. 

23.  Payment is due in full 48 hours before your session unless otherwise agreed.

24.  A £50 non-refundable deposit is required to hold your appointment time, unless otherwise agreed.

 

 

GENERAL

25.  Aggression or behaviour issues must be declared on this form or advised in writing along with acceptance and confirmation of receipt from Paws and Palms Therapy before sessions begin.

26.  If it is recommended following treatment that rehoming or euthanasia is the best option, no refund will be given.

27.  Sessions are non-transferable if rehome is decided.

28.  If the Client fails to attend a training session no refund shall be given.

29.  If the Client is more than 20 minutes late for a training session and has not corresponded with Paws and Palms Therapy to inform them of the delay, the session will be cancelled and no refund shall be given.

30.  If the Client is late to a training session, only the booked time slot for the session shall be given. No extra time shall be added onto the training session to account for the Client arriving late.

31.  Training sessions may be held outside, please wear appropriate clothing and footwear.

32.  Paws and Palms Therapy cannot be held liable for any losses of any kind that arise from this contract or the provision of our services save for death or personal injury caused by negligence. This clause does not attempt to avoid any liability which cannot be excluded by law.

33.  Vaccination and Health Dogs should be fully vaccinated and receive regular flea, tick, and worming treatments, or be titre tested with regular worming checks. If your dog appears unwell before or during training, the session may be cancelled or shortened. No refund will be given. 

34.  All dogs will be kept on a lead for the duration of the training session unless otherwise instructed.

35. Extreme Weather Policy Paws and Palms Therapy may shorten or postpone sessions due to extreme weather (e.g. heat, rain, snow, thunderstorms) to ensure everyone’s safety. A new date will be arranged at a mutually convenient time. 

36.  Covid-19 Disruptions Should Covid-related restrictions arise (lockdowns or changes to rules), training may be rearranged or offered via Zoom. Refunds will not be issued in these cases, and the format is at our discretion.

37. Dog Welfare & Coping If a dog appears overwhelmed, Paws and Palms Therapy may shorten the session at our discretion for their wellbeing.

38.  Kind and Ethical Methods Our methods are kind, ethical, and effective. Instant results are unlikely—progress requires your ongoing commitment during and after the booked sessions.

39.  Dogs must be kept under control when Paws and Palms Therapy is entering your home. Failure to do so and any injury caused by your dog being out of control will be your full responsibility. Where appropriate and directed by us, we will meet outside your home first and in some instances, we may work only outside taking a hands-off approach working at a distance (especially in the case of anxious dogs).

40.  Stooge Dogs Occasionally, stooge dogs may be used in training. You are responsible for keeping your dog under control and at a safe distance from them.

41. Behavioural Cases By booking, you consent to work with us and agree that we may contact your vet if required. 

42.  Bitches in season. Please inform us if your dog is in season so we can assess the suitability of training during this time.

43. I kindly ask you to report any accidents or injuries that may occur during your training sessions to your trainer right away. You and your dog's safety is of utmost importance, and as an owner, it is your duty to ensure that your dog behaves in a manner that does not pose a threat to other animals or people.

44. I welcome children to attend my training sessions as long as they are accompanied by a responsible adult. It is important to note that I cannot take responsibility for the safety of children during the sessions. I kindly ask that supervising adults ensure that the children are safe at all times. Young people under the age of 16 must be accompanied by an adult, unless prior arrangement has been made. Parents/guardians remain fully responsible for the behaviour and safety of any children they bring to the session.

45. If your dog has any known allergies or intolerances to certain foods or has any other special dietary needs, it is your responsibility to bring this to the attention of the trainer prior to the start of your session.

PRIVACY: Please be aware that photographs may be taken during training sessions. These photos may be used by Paws & Palms Therapy for use on social media or to send to your vet practice, this may also include any videos of your dog.. If you do not want photographs of you and/or your dog to be used or shared, please inform me. Additionally, any feedback you provide, whether verbal or written (such as through email or feedback forms), may be used for marketing purposes. Please note that only your first name will be used for identification purposes.

DISCLAIMER Although every effort is made to ensure safety, working with dogs, adults, and children carries inherent risk. By booking, you accept full responsibility for any injuries or damages that may occur and acknowledge that guests are attending at their own risk.
